&lt;p class="MsoPlainText" style="margin: 0in 0in 0pt"&gt;&lt;font face="Consolas" size="3"&gt;James L Grant:&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;Yesterday, I was contacted by Laura and informed that you dropped off some papers for the next BZA hearing.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;Today, I have had a chance to careful review the papers.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;First of all, it is suggested that you go to the Clear Lake web cite and look under &amp;quot;forms&amp;quot; and review the rules adopted by the BZA on August 21, 2006. The BZA made the rules.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;I am merely the messenger.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;The first 4 requirements have not been met and must be before a variance hearing will be scheduled.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;The 4 pages of the application that were have been reviewed.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;You are shown as the applicant, but you are not listed as the owner.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;If you are acting for the owner, then proper authorization is required to accompany the application.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;The owner is listed as a corporation.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;A certified corporate resolution authorizing the filing of the variance request and authorizing you to act on behalf of the corporation is required.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;This would include authorizing you to sign the application on behalf of the&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;corporation and to represent the corporation at the hearing.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;Also, a certified copy of the corporate resolution designating who can sign documents on behalf of the corporation is required.&lt;/font&gt;&lt;/p&gt;
&lt;p class="MsoPlainText" style="margin: 0in 0in 0pt"&gt;&lt;font face="Consolas" size="3"&gt;The rules adopted by the BZA require that the property owners touching the subject property be notified.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;I believe that the Yacht Club property and another property to the Northwest and across the street from the corporate property touches the subject property.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;These are not listed on page 4 of&lt;/font&gt;&lt;/p&gt;
&lt;p class="MsoPlainText" style="margin: 0in 0in 0pt"&gt;&lt;font size="3"&gt;&lt;font face="Consolas"&gt;the application.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;Other matters that are missing is as follows:&lt;span style="mso-tab-count: 1"&gt;&amp;nbsp;&amp;nbsp; &lt;/span&gt;&lt;/font&gt;&lt;/font&gt;&lt;/p&gt;

I think we have to remain content with what we have -- it is, after all, one of the best sailing facilities in Indiana. We might, however, consider a mobile hoist that could be moved into position when needed.&lt;/font&gt;&lt;/font&gt;&lt;/p&gt;
&lt;p class="MsoPlainText" style="margin: 0in 0in 0pt"&gt;&amp;nbsp;&lt;/p&gt;
&lt;p class="MsoPlainText" style="margin: 0in 0in 0pt"&gt;&lt;font size="3"&gt;&lt;font face="Consolas"&gt;Jim - Sorry to be such a pain.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;The zoning ordinance is very clear.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;No permanent structure can be located in the lake yard.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;A structure is anything constructed or erected which requires location in or on the ground or is attached to something having a location in or on the ground.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;The hoist would be attached to something located in the ground and would be permanently attached to a concrete base.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;The &amp;quot;lake yard&amp;quot; is the yard extending across the full width of the lot between the main building and the lake shore.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;The lake yard shall have a minimum depth of 30 feet and no structure may be located in the lake yard.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;Since I wrote to you the other day, I have had a further thought on this matter.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;I believe that this property is in an &amp;quot;R&amp;quot; district.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;A hoist would not be a permitted use in an &amp;quot;R&amp;quot; district.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;&lt;/font&gt;&lt;/font&gt;&lt;/p&gt;

&lt;p class="MsoPlainText" style="margin: 0in 0in 0pt"&gt;&lt;font face="Consolas" size="3"&gt;Also, I have had several conversations with the DNR.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;The local office referred me to a Jerry Price, 765-473-9324 (Peru Office).&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;He informs me that the DNR has jurisdiction over anything install in the ground within 10 feet of the shore line and anything that you extend into or over the public lake.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;I is suggested that anything you may want to do along this line be submitted to the DNR for either an approval of your plans or a certification that there is no objection to your proposed construction project.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;It is further suggested that you may want to consider doing this first before you go to the time and expense of submitting your request for a variance to the BZA.&lt;span style="mso-spacerun: yes"&gt;&amp;nbsp; &lt;/span&gt;Bruce R.
